General Regulations to the Organic Law of Inclusive Circular Economy

Under the guidance of the National Production and Industries Authority and in coordination with the  National Environmental Authority, this regulation seeks to establish and update the National Inclusive Circular Economy Strategy. The strategy addresses a wide range of criteria such as the promotion of circular development models, economic well-being, research, innovation, waste management and intersectoral collaboration, among others. In addition, it establishes the linking of the goals and indicators of this strategy in the institutional planning of government entities and underlines the importance of recording budget resources allocated to projects related to the circular economy.

Reforms to the General Regulations of the Organic Law of the National Public Procurement System

 

Source: Decree No. 847 (RO 381-3S, 24-VIII-2023)

 

Among the different reforms that were incorporated into the General Regulations of the Organic Law of the National Public Procurement System, we have the following: 

 

  • It is established that certain contracts for international services related to the sponsorship or advice of the Ecuadorian State will be excluded from the regulations that govern the National Public Procurement System. 
  • The procedure for the return of incomplete or imprecise applications is modified, establishing specific deadlines for the delivery of additional information required by the General Comptroller of the State. 
  • The selection of suppliers of drugs or strategic health goods will be carried out through the corporate reverse auction procedure. 
  • The technical specifications of pharmaceuticals and strategic health goods are established to be drawn up by the national health authority and must be included in the contracting documents. 
  • Articles 6 and 7 detail the conditions and procedures under which a special regime will be applied for the contracting of certain drugs and strategic health goods.

The reforms mainly seek to optimize the public procurement process in Ecuador, allowing flexibility in certain cases and focusing on efficiency, transparency and care of public resources.
